Terms of Service & EULA

Please read these Terms of Service and End User License Agreement ("Terms") carefully before using any mobile application or digital product developed and published by Trigemeo ("we", "our", "us").

By downloading, installing, or using any Trigemeo application, you agree to be bound by these Terms. If you do not agree, do not use our applications.

1. About Trigemeo

Trigemeo is an independent game and software development studio.

• On Apple App Store: Applications are published by Alexandr Ivanov (individual developer).
• On Google Play: Applications are published and operated by Freebird s.r.o. (IČO: 27942350, Czech Republic) under a license agreement with the intellectual property owner.

All intellectual property rights in Trigemeo applications are owned by Alexandr Ivanov.

2. License Grant

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to download, install, and use our applications on devices that you own or control, solely for your personal, non-commercial entertainment or utility purposes.

You may NOT:

• Copy, modify, distribute, sell, or lease any part of our applications.
• Reverse-engineer, decompile, or disassemble our applications.
• Use our applications for any commercial purpose without our written consent.
• Exploit bugs, glitches, or design errors for unfair advantage in multiplayer modes.
• Use automated scripts, bots, or cheating tools.

3. In-App Purchases & Subscriptions

3.1. Some of our applications offer premium features, content, or functionality available through in-app purchases or subscriptions.

3.2. All purchases and subscriptions are processed exclusively through the Apple App Store or Google Play Store. We do not process payments directly and do not have access to your payment information.

3.3. Subscription terms:

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage and cancel subscriptions through your Apple ID or Google Play account settings.
• Pricing may vary by region and is displayed in your local currency at the time of purchase.

3.4. Refund policy: Refund requests are handled by Apple or Google in accordance with their respective refund policies. We cannot process refunds directly.

3.5. Restore Purchases: If you reinstall an app or switch devices, you can restore previously purchased content using the "Restore Purchases" function within the app.

4. Online & Multiplayer Features

4.1. Certain applications (e.g., Brandub) offer online multiplayer functionality through Apple Game Center or Google Play Games Services.

4.2. When using multiplayer features, you agree to:

• Treat other players with respect and sportsmanship.
• Not use cheats, exploits, or third-party tools to gain unfair advantages.
• Not engage in harassment, hate speech, or abusive behavior.

4.3. We reserve the right to restrict or suspend access to online features for users who violate these conduct guidelines.

5. Advertising

5.1. Some of our free applications may display advertisements provided by third-party ad networks (e.g., Google AdMob).

5.2. Ad content is served by third-party providers and does not reflect the views or endorsements of Trigemeo.

5.3. On iOS, you will be asked for your consent before ad-related tracking occurs (App Tracking Transparency). You can change your preference at any time in your device settings.

6. User-Generated Content

Our applications generally do not support user-generated content. If this changes in future updates, additional terms will apply and will be communicated to you.

7. Intellectual Property

7.1. All game assets, source code, artwork, audio, music, animations, themes, logos, trademarks, and branding within our applications are the exclusive property of Trigemeo (Alexandr Ivanov) and are protected by international copyright, trademark, and intellectual property laws.

7.2. The Trigemeo name, logo, and all related product names are trademarks of Alexandr Ivanov. You may not use them without prior written permission.

7.3. Nothing in these Terms grants you any right, title, or interest in our intellectual property.

8. Disclaimer of Warranties

8.1. Our applications are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2. We do not warrant that our applications will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

9.1. To the maximum extent permitted by applicable law, Trigemeo, Alexandr Ivanov, and Freebird s.r.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of our applications.

9.2. Our total aggregate liability for any claims arising from these Terms or your use of our applications shall not exceed the amount you paid to us (if any) for the specific application giving rise to the claim during the 12 months preceding the claim.

9.3. Nothing in these Terms limits your statutory consumer protection rights under applicable EU law.

10. Age Requirements

10.1. Our applications are generally intended for users aged 13 and older, unless otherwise specified in the app's store listing.

10.2. If you are under the age of legal majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

10.3. We do not knowingly offer applications designed for or directed at children under 13.

11. Termination

11.1. You may stop using our applications at any time by uninstalling them from your device.

11.2. We may suspend or terminate your access to our applications or services if you violate these Terms or engage in conduct that we determine to be harmful to other users or to Trigemeo.

11.3. Upon termination, your license to use the application is immediately revoked. Sections 7–9 survive termination.

12. Governing Law & Dispute Resolution

12.1. These Terms are governed by the laws of the Czech Republic, without regard to its conflict of laws principles.

12.2. For users in the European Union: Nothing in these Terms affects your rights under mandatory EU consumer protection legislation, including the right to bring claims in the courts of your country of residence.

12.3. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to the competent courts of the Czech Republic (Městský soud v Praze).

12.4. EU Online Dispute Resolution: The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will update the "Last Updated" date. Continued use of our applications after changes constitutes your acceptance. If you do not agree with updated Terms, please discontinue use and uninstall the application.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
